PukPuk App Terms of Use

Effective date: 30 June 2024

These Terms set out the rules for using the PukPuk mobile application (the “App”), provided by Mk Consulting Michał Klepaczko, al. Solidarności 117/207, 00-140 Warsaw (the “Administrator”).

By using the App, you accept these Terms.

Use of the Borrow module is governed by a separate document that forms an integral part of these Terms: Rental Terms.

1. General Provisions

  1. The PukPuk App enables users to:
    • Create and manage an account
    • Publish content (e.g., posts, comments)
    • Receive local notifications and offers
    • Use features supporting local communities and businesses
    • Use the Borrow module, on the terms set out in the Rental Terms
  2. Using the App requires acceptance of these Terms, the Privacy Policy and — when using the Borrow module — the Rental Terms, which form an integral part of these Terms.

2. Registration and User Account

  1. Some features require creating an account.
  2. You must provide accurate registration data.
  3. You are responsible for keeping your password secure and must not share it with third parties.

3. Prohibited Content and Conduct

It is forbidden to publish or distribute content that:

  • Violates the law or third-party rights
  • Contains hate speech, discriminatory, offensive, vulgar or obscene content
  • Promotes violence, drug abuse, gambling or pornography
  • Constitutes spam, advertising without the Administrator’s consent or includes malware
  • Misleads other users, impersonates persons or institutions

The Administrator may remove content violating the Terms and block users who repeatedly breach the rules.

4. User Rights and Obligations

  1. Use the App in accordance with the law, good practice and these Terms.
  2. You are fully responsible for the content you publish.
  3. You may request deletion of your account by contacting the Administrator.

5. Administrator’s Rights and Obligations

  1. The Administrator strives for continuous, error-free operation of the App.
  2. The Administrator may temporarily suspend the App for maintenance, updates or technical reasons.
  3. The Administrator is not responsible for user-generated content but may remove it if it violates the Terms.

6. Liability

  1. The Administrator is not liable for damages resulting from using the App contrary to these Terms.
  2. You use the App at your own risk.
  3. Regarding the Borrow module, the Administrator provides only an informational and technical tool that facilitates contact and management of rentals between users. Detailed rules and liability exclusions are set out in the Rental Terms.

7. Changes to the Terms

The Administrator may change these Terms. Users will be informed by publishing a new version in the App and — where possible — via email.

9. Final Provisions

  1. These Terms are governed by Polish law.
  2. Matters not regulated herein are governed by the Civil Code and other applicable laws.
