Borrow Module Terms
Effective date: 15 June 2026
These Borrow Module Terms (the “Rental Terms”) form an integral part of the PukPuk App Terms of Use (the “Main Terms”) and set out the rules for using the feature that enables users to rent items from one another in the PukPuk mobile application (the “App”).
The Rental Terms are provided by Mk Consulting Michał Klepaczko, al. Solidarności 117/207, 00-140 Warsaw (the “Administrator”). Matters not covered by these Rental Terms are governed by the Main Terms and the Privacy Policy.
By using the Borrow module, you accept the Main Terms and these Rental Terms.
Glossary
- App — the PukPuk mobile application and related digital services.
- Borrow module — the App feature enabling users to publish rental listings, search for items, make reservations, communicate and manage rental statuses.
- User — a natural person with an App account who uses the Borrow module.
- Owner — a User who publishes a listing to rent out an item.
- Renter — a User who submits a reservation or uses a rented item.
- Listing — content, photos, pricing, an optional deposit and other information about an item published by the Owner in the Borrow module.
- Reservation — a request to rent an item for selected dates, submitted by the Renter through the App.
- Rental — an arrangement between the Owner and the Renter to rent an item, which may be recorded in the App.
- Deposit — an optional amount set by the Owner, the settlement terms of which are determined solely by Users outside the App, unless the Listing expressly states otherwise.
1. Subject and nature of the service
- The Borrow module enables Users to publish Listings for renting items and to search for such Listings in their area.
- The App facilitates communication between Users, submitting Reservations, confirming pickup and return of items, and collecting reviews after a Rental ends.
- The Administrator is not a party to rental agreements entered into between Users. PukPuk does not act as a rental intermediary, rental agency, representative, agent or guarantor for either party to a transaction.
- The Administrator provides only an informational and technical tool that facilitates contact and management of the rental process. Decisions regarding whether to enter into a Rental, its terms, price, deposit, pickup, return and settlement rest solely with Users.
- Using the Borrow module does not constitute entering into an agreement between a User and the Administrator regarding the rental of a specific item.
2. Borrow module features
The Borrow module may in particular enable:
- browsing rental Listings in the area;
- selecting dates and submitting a Reservation;
- contact between the Owner and the Renter via chat and phone number;
- confirming pickup and return of an item in the App;
- displaying Rental status in the App and in chat;
- leaving ratings and reviews after a Rental ends;
- displaying the Owner’s average rating on a Listing when they have enough reviews;
- receiving reminders about pickup, return and overdue items;
- publishing a Listing with a description, photos, pricing (e.g. per day) and an optional deposit;
- enabling online reservations or private rentals available only via a link;
- managing active Rentals, Reservations and reviews in the User profile.
The Administrator reserves the right to modify, limit or withdraw individual Borrow module features.
3. Conditions of use
- Only Users who are at least 18 years old and have full legal capacity may use the Borrow module.
- A phone number is required to use the Borrow module and to publish Listings. The User agrees that their contact details will be shared with the other party after a Reservation is submitted or contact is initiated in connection with a Rental.
- The User must provide true, current and complete information in Listings, their profile and when communicating with other Users.
- The User is responsible for the security of their account, password and the device they use.
- The User agrees to use the Borrow module in accordance with the law, the Main Terms, these Rental Terms and good practice.
4. Listings and Owner obligations
- The Owner is responsible for the content, legality, accuracy and completeness of the Listing, including the item’s condition, price, deposit and rental terms.
- The Owner represents that they are entitled to rent out the item and that making it available does not infringe third-party rights.
- The Owner sets their home location using GPS. The Listing shows an approximate area, not the User’s exact home address, unless the App indicates otherwise.
- The Owner may decide whether the Listing accepts online Reservations or is available only as a private rental via a link.
- The Owner is responsible for handing over the item to the Renter, its technical condition, safe use in line with its purpose and for returning any deposit agreed between the parties.
- The Owner may reject or accept a Reservation according to the features available in the App. Until confirmed by both parties, no binding agreement regarding the Rental is formed.
5. Reservations and Renter obligations
- The Renter submits a Reservation by selecting dates and sending a request in the App. A Reservation is an invitation to reach an agreement, not an automatic rental contract.
- The Renter must read the Listing, the Owner’s rating and rental terms, and agree pickup and return details before the Rental begins.
- The Renter must use the item in line with its purpose, with due care, and return it on the agreed date and in the agreed condition, allowing for normal wear from proper use.
- The Renter is liable for damage to the item caused intentionally or through negligence, in accordance with arrangements between Users and applicable law.
6. Agreements between Users
- After a Reservation is accepted or terms are agreed between Users, an arrangement is formed solely between the Owner and the Renter. The Administrator is not a party to that arrangement and is not liable for its conclusion, performance, termination or consequences.
- Rental terms, including price, payment method, deposit, pickup and return time and place, are determined by Users themselves, most often via chat or phone.
- Pickup and return confirmations in the App serve only to document the Rental within the App and do not replace agreements or documents required by law.
- Any disputes regarding non-performance or improper performance of a Rental are resolved between Users. The Administrator is not obliged to mediate, arbitrate or decide such disputes.
7. Payments and deposit
- Financial settlements relating to a Rental, including rental fees and deposits, take place directly between Users, unless the App expressly indicates a different settlement method for a given feature.
- The Administrator does not guarantee payment, and is not liable for non-payment, payment delays or deposit refunds between Users.
- The Administrator does not provide payment services, does not hold escrow accounts for Users and does not insure items rented through the Borrow module, unless expressly announced in separate terms for a given feature.
- The User is solely responsible for properly settling tax and insurance obligations arising from regularly renting out items or earning income from rentals.
8. Pickup, return and reminders
- Users agree pickup and return details themselves. The Administrator does not organise transport, delivery or collection of items.
- The App may enable confirmation of pickup and return and display of Rental status.
- Reminders sent by the App are auxiliary and do not release Users from obligations arising from their arrangements.
- Late return, damage to an item or failure to return it must be resolved directly between the Owner and the Renter.
9. Ratings and reviews
- After a Rental ends, the Renter may leave a rating and review of the Owner.
- Ratings and reviews should relate to the actual course of the Rental, be truthful and lawful. Publishing offensive, misleading content or content that infringes personal rights is prohibited.
- The Administrator may moderate, hide or remove ratings and reviews that violate the Main Terms, these Rental Terms or the law.
- Ratings are subjective opinions of Users. The Administrator does not guarantee their truthfulness, completeness or usefulness.
10. Location, privacy and safety
- In the Borrow module, an approximate item location is shown, not the User’s exact home address, unless Users voluntarily share such an address beyond what the App requires.
- Users should exercise caution when arranging meetings, sharing contact details and handing over valuable items to third parties.
- The Administrator does not verify User identity, the legal status of items or the credibility of Listings, unless expressly indicated in the App.
- Personal data processing in connection with the Borrow module is carried out in accordance with the Administrator’s Privacy Policy.
11. Permitted and prohibited items
- Only items whose rental is lawful and that can be safely used by the Renter in line with the Listing description may be published through the Borrow module.
- It is prohibited to publish Listings relating in particular to:
- items originating from crime or infringing intellectual property rights;
- weapons, explosives, dangerous substances or items prohibited by law;
- items whose rental requires a permit, licence or special legal conditions if the User does not meet them;
- content or items of a sexual, discriminatory, dangerous nature or contrary to the Main Terms.
- The Administrator may refuse publication, hide or remove a Listing that violates the law or the Terms, and may block a User account.
12. Administrator liability
- The Administrator is not liable for Listing content, accuracy of descriptions, item condition, User conduct, the course of Rentals, damage, theft, loss, damage to items, non-payment, non-performance or improper performance of arrangements between Users.
- The Administrator does not control the quality, safety, legality or availability of items offered for rent and does not guarantee that a Rental will take place.
- The Administrator provides no warranty, statutory guarantee, insurance, legal or technical advice regarding items rented through the App.
- The Administrator is not liable for indirect damage, lost profits, data loss, App downtime or other consequences of using or being unable to use the Borrow module, to the fullest extent permitted by law.
- The User uses the Borrow module at their own risk and agrees to release the Administrator from liability for third-party claims arising from content published by the User, legal violations or arrangements between Users, to the extent permitted by law.
13. User liability
- The User is fully responsible for content published in Listings, communication with other Users and the consequences of arrangements they enter into.
- The Owner is responsible for the accuracy of the Listing and for handing over the item in accordance with the arrangements.
- The Renter is responsible for how the item is used and for returning it in accordance with the arrangements.
- Users agree to remedy damage caused to other Users, the Administrator or third parties in connection with use of the Borrow module.
14. Reporting violations
Content that violates the law, the Main Terms or these Rental Terms may be reported to the Administrator at: michal.klepaczko@pukpuk.app. A report should identify the specific Listing or content and describe the violation. The Administrator reviews reports at its discretion, within the limits of applicable law.
15. Changes to the Rental Terms
The Administrator may change these Rental Terms. Users will be informed by publishing a new version in the App or on the Administrator’s website and — where possible — by email. Continued use of the Borrow module after changes take effect constitutes acceptance of the new version of the Rental Terms.
16. Final provisions
- These Rental Terms are governed by Polish law.
- Matters not regulated herein are governed by the Main Terms, the Privacy Policy and the Civil Code and other applicable laws.
- In the event of a conflict between the Main Terms and these Rental Terms regarding the Borrow module, the Rental Terms prevail.
